BACB Discipline and Your State Licenses

Most state behavior analyst licenses rest on BACB certification, so a BACB sanction or an inactive certification travels straight to every state you are licensed in. Texas wants notice within 30 days. Nevada and Texas will not renew without valid certification. And state discipline flows back to the BACB the same way.

Because most state licenses depend on BACB certification, BACB discipline or an inactive certification affects every license. Texas requires notice within 30 days of BACB disciplinary action and will not renew an active license on an inactive certification; Nevada renewal requires certification in good standing. State board actions must in turn be self-reported to the BACB within 30 days.

A behavior analyst's state licenses and BACB certification are separate credentials, issued by different bodies for different purposes. The BACB says it "can enforce its own certification and ethics requirements but does not regulate the ability to practice behavior analysis in any jurisdiction" (December 2025 Newsletter). But in most states the license is built on the certification, so trouble with one becomes trouble with the other, in both directions.

How does BACB action reach a state license?

Through three channels: eligibility, renewal and reporting.

  • Eligibility. Many states require current certification to hold a license at all. Nevada's definition of a behavior analyst includes holding current BCBA certification (NRS 641D.030). Virginia requires current BCBA certification and that the applicant is not the subject of disciplinary proceedings by the certifying board (Va. Code § 54.1-2957.16(B)).
  • Renewal. TDLR says your BACB or QABA certification "must be current and in good standing before your Texas license can be renewed," and that you may not renew an active Texas license with an inactive certification. Nevada's renewal requires evidence that your BACB certification "remains valid and the holder remains in good standing" (NRS 641D.360).
  • Reporting. TDLR requires license holders to notify it "within 30 days of any initiation of disciplinary action by the Behavior Analyst Certification Board."

Virginia also asks every applicant for "verification from the BACB on disciplinary action taken or pending by that body" (18VAC85-150-50), and Nevada's endorsement route requires proof you have not been disciplined or investigated by the BACB (NRS 641D.340).

Does an inactive certification count as discipline?

It is not discipline, but it can have a similar effect on a license. The BACB says BCBAs may become inactive by choosing voluntary inactive status, by not recertifying on time, or because of sanctions, and that inactive BCBAs "may not bill, practice, supervise, or represent themselves as active BCBAs" (BCBA Handbook, updated June 2026). A BCaBA without a supervisor on record is also treated as inactive.

In a state where the license depends on current certification, an inactive certification can block renewal (Texas) or undercut eligibility (Nevada). Before taking voluntary inactive status for a break, check every state where you are licensed. Texas, for instance, says that if your certification is inactive you may only renew a Texas license that is also on inactive status.

How does state discipline reach the BACB?

Through self-reporting. The BACB requires certificants to self-report, within 30 days, any investigation by a licensure or regulatory board triggered by a complaint, and required actions such as probation, suspension, practice restrictions or mandatory continuing education assigned by a licensure board in response to a complaint, audit or investigation. Settlement or consent agreements with a licensure board are on the list too (BCBA Handbook). Its guidance is blunt: "If it is not required that you self-report your situation to the BACB, but you are still unsure, the best course of action is to self-report."

The BACB also connects unlicensed practice to certification. Practicing or supervising without the required license "may result in action against a certificant's BACB certification and/or their future ability to become licensed in that state" (December 2025 Newsletter).

Does discipline in one state follow you to another?

Discipline in one state is a question on the next state's application, and often a ground for action. Illinois may discipline a licensee for adverse action taken by another state on substantially equivalent grounds (225 ILCS 6/60(a)(11)). Washington requires that an applicant not be currently subject to disciplinary proceedings (RCW 18.380.050). A behavior analyst licensed in several states should expect one matter to surface everywhere.

Which steps make sense when a matter opens?

  1. Calendar the deadlines. 30 days for BACB self-reports; 30 days for TDLR notice of BACB action.
  2. List every license. Each state has its own reporting rule and its own renewal question.
  3. Keep answers consistent. What you tell the BACB and each board should describe the matter the same way.
  4. Watch renewal dates. A renewal that falls during an open matter needs careful answers; see keeping renewals on one calendar.
  5. Get counsel. We prepare and track paperwork; legal strategy belongs to an attorney.

Where do we fit in?

Our Annual Renewal and CE Compliance service ($299 per license, per year) tracks each license's renewal date, reporting obligations and CE alongside your BACB cycle, and prepares renewal paperwork for your review and submission. We do not represent you before the BACB or a board. For applications in a new state with a history to explain, see disclosing discipline on an ABA application and why BACB certification is not a state license.

Common questions

Do I have to tell my state board about BACB disciplinary action?
In some states, yes. TDLR requires Texas license holders to notify it within 30 days of any initiation of disciplinary action by the BACB. Other states ask about BACB action on applications and renewals, so check each state where you are licensed.
Can I keep my state license if my BCBA goes inactive?
It depends on the state. Texas says you may not renew an active license with an inactive certification, though an inactive Texas license can be renewed. Nevada renewal requires that your BACB certification remain valid and in good standing.
Do I report state board discipline to the BACB?
Yes. The BACB requires self-reporting within 30 days of investigations by licensure boards triggered by complaints, and of required actions, settlements or consent orders with a licensure board.
Is BACB certification the same as a license?
No. The BACB certifies; states license. The BACB says it does not regulate the ability to practice in any jurisdiction, but many states require current certification to get and keep a license.
